Solicitors must comply with the Solicitors Regulatory Authority (SRA) rules and regulations. The outcomes approach which the SRA has established, is vital to providing confidence in your provision of legal services to the public. An annual s.34 examination, together with an Accountants’ Report is part of the process to ensure client monies are safeguarded.

Your Section 34 Examination Obligations

All solicitors who hold client monies (subject to certain exemptions) must comply with the current Solicitors Accounts Rules (SAR) and have a registered auditor conduct a s.34 examination within 6 months of the end of an accounting period.

The rules apply to all firms and sole practitioners that are regulated by the SRA. It is the COFA and COLP’s responsibility to ensure compliance.

Regulated entities are required to have systems and controls in place to ensure compliance with the rules. The nature of those systems must be appropriate to the nature and volumes of client transactions dealt with and the amount of client money held or received.
